Democrats said the town could have set up a process to decide which flags were and were not fit for display on public property. Republicans argued it put the town on safer legal ground as well as avoided lengthy debates on which groups’ flags were appropriate for town buildings. Republicans on the Town Council prevailed over Democrats last week to pass the flag ordinance in a party-line vote. While the case was pending, some Southington officials cited the lawsuit as a reason for a prohibition on all but government flags flying over town buildings. The court unanimously decided that Boston violated the free speech rights of a conservative activist when the city refused his request to fly a Christian flag on a flagpole outside City Hall.
